Contrairement au licenciement pour motif personnel, il n&rsquo;est pas li\u00e9 \u00e0 la faute ou \u00e0 l&rsquo;insuffisance du salari\u00e9.<\/p>\n\n\n\n<p>Les principaux motifs sont :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Les difficult\u00e9s \u00e9conomiques<\/strong> : baisse significative du chiffre d&rsquo;affaires ou des commandes, pertes d&rsquo;exploitation, tr\u00e9sorerie d\u00e9grad\u00e9e.<\/li>\n\n\n\n<li><strong>Les mutations technologiques<\/strong> : automatisation, transformation num\u00e9rique, innovation radicale.<\/li>\n\n\n\n<li><strong>La r\u00e9organisation n\u00e9cessaire \u00e0 la sauvegarde de la comp\u00e9titivit\u00e9<\/strong>.<\/li>\n\n\n\n<li><strong>La cessation d&rsquo;activit\u00e9<\/strong> de l&rsquo;entreprise, de mani\u00e8re totale et d\u00e9finitive.<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n<h2 class=\"wp-block-heading\" id=\"quelles-sont-les-obligations-de-lemployeur\">Quelles sont les obligations de l&#8217;employeur ?<\/h2>\n\n\n<p>L&#8217;employeur doit respecter une proc\u00e9dure rigoureuse qui varie selon le nombre de salari\u00e9s concern\u00e9s :<\/p>\n\n\n<h3 class=\"wp-block-heading\" id=\"licenciement-economique-individuel\">Licenciement \u00e9conomique individuel<\/h3>\n\n\n<ul class=\"wp-block-list\">\n<li>Entretien pr\u00e9alable avec le salari\u00e9.<\/li>\n\n\n\n<li>Notification par lettre motiv\u00e9e.<\/li>\n\n\n\n<li>Information de l&rsquo;administration du travail (Dreets) dans certains cas.<\/li>\n<\/ul>\n\n\n<h3 class=\"wp-block-heading\" id=\"licenciement-economique-collectif\">Licenciement \u00e9conomique collectif<\/h3>\n\n\n<ul class=\"wp-block-list\">\n<li>Consultation du CSE obligatoire.<\/li>\n\n\n\n<li>Information renforc\u00e9e \u00e0 la Dreets.<\/li>\n\n\n\n<li>Mise en place d\u2019un <strong>Plan de sauvegarde de l\u2019emploi (PSE)<\/strong> si au moins 10 salari\u00e9s sont licenci\u00e9s sur 30 jours.<\/li>\n<\/ul>\n\n\n\n<p>Par ailleurs, l&#8217;employeur a une obligation de <strong>reclassement<\/strong> : il doit proposer des postes disponibles dans l&rsquo;entreprise ou le groupe, en France ou \u00e0 l&rsquo;\u00e9tranger.<\/p>\n\n\n\n<p><\/p>\n\n\n<h2 class=\"wp-block-heading\" id=\"quels-sont-les-droits-du-salarie-licencie\">Quels sont les droits du salari\u00e9 licenci\u00e9 ?<\/h2>\n\n\n<p>Le salari\u00e9 licenci\u00e9 \u00e9conomiquement dispose de plusieurs garanties :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Indemnit\u00e9 de licenciement<\/strong>, calcul\u00e9e selon l&rsquo;anciennet\u00e9.<\/li>\n\n\n\n<li><strong>Indemnit\u00e9 compensatrice de pr\u00e9avis<\/strong>, sauf ex\u00e9cution effective.<\/li>\n\n\n\n<li><strong>Contrat de s\u00e9curisation professionnelle (CSP)<\/strong> ou <strong>cong\u00e9 de reclassement<\/strong> selon la taille de l&rsquo;entreprise.<\/li>\n\n\n\n<li><strong>Priorit\u00e9 de r\u00e9embauche<\/strong> pendant 12 mois.<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n<h2 class=\"wp-block-heading\" id=\"les-erreurs-a-eviter\">Les erreurs \u00e0 \u00e9viter<\/h2>\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Motif \u00e9conomique non r\u00e9el et s\u00e9rieux<\/strong> : la justification doit \u00eatre pr\u00e9cise, objective et actuelle.<\/li>\n\n\n\n<li><strong>Absence de recherche de reclassement<\/strong> : cette obligation est une condition de validit\u00e9.<\/li>\n\n\n\n<li><strong>Proc\u00e9dure incompl\u00e8te<\/strong> : le non-respect des \u00e9tapes rend le licenciement irr\u00e9gulier.<\/li>\n<\/ul>\n\n\n\n<p>La contestation devant le conseil de prud\u2019hommes peut aboutir \u00e0 des dommages-int\u00e9r\u00eats pour licenciement abusif.<\/p>\n\n\n\n<p><\/p>\n\n\n<h2 class=\"wp-block-heading\" id=\"conclusion\">Conclusion<\/h2>\n\n\n<p>Le licenciement \u00e9conomique est un levier de gestion des ressources humaines encadr\u00e9 juridiquement.
